Oliver Schor, age 22, and Christopher Fernandez, age 28, both of Sound Beach, were formally arraigned on murder charges in Suffolk County Court on Friday, Aug. 9, in the fatal shooting of Michael Hartmann.
According to prosecutors, Fernandez and Schor were armed with rifles when they showed up at Hartmann’s Bohemia residence, located just south of the Sunrise Highway on Smithtown Avenue, at around 6:30 a.m. on Nov. 2, 2022.
They were about to enter the home through a rear door when they encountered Hartmann. Schor then opened fire, killing the man, before they fled in Schor’s mother’s car, prosecutors allege.
A Suffolk County Police investigation found that the defendants thought Hartmann was someone else.
Prior to the killing, Fernandez robbed an employee at an Exxon Mobil gas station in Manorville, prosecutors said. Nobody was injured.
“This case involves the heartbreaking loss of Michael Hartmann, a husband, father and beloved family man, who was brutally killed at his own home,” said Suffolk County District Attorney Raymond Tierney.
“We are committed to seeking justice for him. Our condolences go out to the Hartmann family during this difficult time.”
Schor was arrested as a fugitive from justice in Lexington, South Carolina, with the assistance of the Lexington County Sheriff’s Department.
He is charged with first-degree murder and two counts of second-degree murder, while Fernandez is charged with second-degree murder.
Both men are also charged with attempted burglary, criminal possession of a weapon, and criminal use of a firearm.
Fernandez is additionally charged with robbery stemming from the alleged incident in Manorville. Both men were jailed without bail while their cases proceed.
